The Constitutional Court (MK) rejected lawsuit number 70/PUU-XXII/2024 filed by UIN Syarif Hidayatullah Jakarta student A Fahrur Rozi and Podomoro University student Anthony Lee.

In the verdict, the panel of judges emphasized that the age requirement for regional head candidates is calculated from the time the person concerned is determined as a regional head candidate by the KPU.

“The minimum age requirement must be met by regional head candidates and deputy regional head candidates when registering as candidates,” said Deputy Chief Justice of the Constitutional Court Saldi Isra during the verdict reading hearing at the Constitutional Court Building, Central Jakarta, Tuesday (20/8/2024).

However, Legal Practitioner Nasrullah is of the opinion that the Constitutional Court (MK) decision No. 70/PUU-XXII/2024 does not contain a ruling that changes the provisions regarding the age requirement for gubernatorial candidates at 30 years of age.

“So that the norm remains in effect, even though the applicant’s application was declared rejected by the Constitutional Court,” said Nasrullah, Tuesday (20/8/2024).

He said that the Supreme Court’s interpretation did not conflict with the provisions of applicable laws and regulations, especially the provisions on age requirements for gubernatorial candidates in the Regional Election Law.

According to Nasrullah, the Constitutional Court itself in its decision did not include an order that canceled or made constitutional provisions regarding the age requirements for gubernatorial candidates in the Regional Election Law in order to limit the interpretation of these provisions.

“In my opinion, any young person who has met the requirements to be nominated, there is still room for them to be nominated in this regional election contest,” he concluded.
