New Delhi: The Narcotics Control Bureau (NCB) told the Supreme Court on Tuesday that it will not be investigating actress Rhea Chakraborty in connection with the probe into the drug case linked to the death of actor Sushant Singh Rajput. Not challenging the bail granted to Rhea Chakraborty. Additional Solicitor General (ASG) SV Raju told a bench of Justice AS Bopanna and Justice MM Sundaresh that, ‘NCB is not challenging the bail, but Section 27 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act- The question of law in respect of A must be kept open.’
The top court, which was hearing NCB’s plea against the Bombay High Court order granting bail to Sushant Singh Rajput’s girlfriend Chakraborty, took note of the ASG’s submission on the change in NCB’s stand on bail to the actress, but clarified that the High Court The decision of the court shall not be taken as a precedent in any other case. The bench said, “After hearing the submissions of the ASG, there does not seem to be any need to challenge the impugned order granting bail at this stage.”
The NCB has charged Chakraborty under section 27-A of the NDPS Act, which deals with ‘funding and abetting illicit drug trafficking’. In this, there is a provision of imprisonment up to 10 years and ban on grant of bail. The High Court had said that paying for a drug transaction does not amount to financing drug trafficking. It had said, “Therefore, the allegation against the applicant of spending money in procuring drugs for Sushant Singh Rajput would not mean that he had given money for illegal trafficking.”
