Ministry of Communication and Information Warns 6 Foreign Travel Agents to Register for PSE, There are Agoda and Airbnb

Liputan6.com, Jakarta – The Ministry of Communication and Information (Communications and Informatics) stated that it had sent warning letters to six foreign OTAs (online travel agents) who had not registered their companies as private sector PSEs in Indonesia. The warning letter was sent on March 5 2024.

In a press release received on Friday (8/3/2024), the six foreign travel services that received warning letters from the Ministry of Communication and Information were Booking.com, Agoda.com, Airbnb.com, Klook.com, Trivago.co.id, and Expedia .co.id.

“Within 5 (five) days from the sending of the Warning Letter, foreign OTAs are required to register for Private Scope PSE (Electronic System Providers) in accordance with statutory regulations,” wrote the Ministry of Communication and Information.

It was further explained that the government can provide assistance in carrying out registration based on responses and related OTA requests. If there is no response from the travel agent, the Ministry of Communication and Information can provide administrative sanctions in the form of terminating access.

For your information, this registration obligation actually does not only apply to Foreign Private PSE, but also Domestic Private PSE. This policy is regulated in Article 4 of the Minister of Communication and Information Regulation 5/2020.

For information, PM Kominfo 5 of 2020 as amended by PM Kominfo 10 of 2010 concerning Amendments to Regulation of the Minister of Communication and Information Number 5 of 2020 concerning Private Scope PSE Organizers who are required to register.

In this regulation, it is stated that Private Scope PSEs that are required to register are PSEs that have portals, sites or applications on the internet network.

This registration policy is a data collection mechanism for PSEs that provide their services in Indonesia. Apart from that, this registration is carried out to build a safe and trustworthy Indonesian digital ecosystem.

Private Scope PSEs that are required to register are required to submit a number of information, such as the identity of the organizer, name of the electronic system, official URL of the website, type of data processed, location of data management or processing.

Through this registration, the public can find out which PSE provides services to them. Considering the importance of registration in building the national digital ecosystem, any PSE that does not carry out its obligations may be subject to administrative sanctions.
