Judge bars Manu Bahtidão's R$300,000 show in Ribeirão Cascalheira, MT – Cidades na Net

The Mato Grosso Court ordered the suspension of singer Manu Bahtidão's show in Ribeirão Cascalheira, a municipality with 10,000 inhabitants located 885 kilometers from Cuiabá. The contract provided for a fee of R$295,000 for the singer to perform at the 9th Queima do Alho party.

When blocking the show, judge Michele Cristina Ribeiro de Oliveira, from the Vara Única de Ribeirão Cascalheira, warned of the 'indiscriminate and obscure allocation of values ​​at festive events'.

The judge highlighted problems in sectors of 'primary need' in the municipality, such as health, education, road safety and transport.

Michele Cristina's decision was published on Friday, 3, in the context of a lawsuit filed by the state Public Ministry. The Prosecutor's Office alleged 'disproportionality between priority actions and systematic violations of fundamental rights'

The Prosecutor's Office noted that hiring Manu Bahtidão's show would be paid for by the municipality, including hotel, food and dressing room expenses.

The budget allocation listed by the city hall for Manu's show was R$ 295 thousand, not counting accommodation and food expenses for 25 members of the band, vans for local transfers, supply of dressing rooms, porters for loading and unloading the contractor's material, stage, sound, lighting and physical structure of the dressing rooms. The total estimated expenses for the entire party in Ribeirão Cascalheira was R$372 thousand.

The Prosecutor's Office pointed out 'erosion of constitutional awareness' with the expenditure planned for the 9th Queima do Alho while the municipality would be 'suffering from the absence of effective actions by the entity in the materialization of fundamental rights, such as basic sanitation, pre-school education, revitalization of roads'.

When analyzing the case, judge Michele Cristina Ribeiro de Oliveira pointed out 'violation of the fundamental rights of citizens and, in principle, a series of violations of the principles of budgetary legality, including that of publicity and transparency'.

“The purpose of the public budget is the delivery of goods and services to satisfy the needs of society”, he noted.

The judge also pointed out that the suspension of the show is a reversible measure. According to her, Manu's presentation may eventually be held on another date.

“The community will have the opportunity to enjoy the cultural activity with the security, after due evidentiary instruction, that they are not neglecting the correct application of public money”, pointed out the judge.

On the other hand, she understood that it was necessary to stop the show considering that the event would be held and the amounts spent would not return to the public coffers, 'if irregularities were confirmed'.
